Terms and Conditions for Retriever

Agreement to Terms

By accessing or using the Retriever mobile application (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Alchemy Technologies ("we," "us," or "our"), the operator of Retriever.

Apple's Standard End User License Agreement (EULA) also applies to your use of the App. You can read it at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.

Age Requirement

You must be at least 13 years of age to use Retriever. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

Description of Service

Retriever provides:

  • Voice-to-text transcription of notes you record
  • AI-powered cleanup and structuring of your recordings into organized, titled, tagged notes
  • Voice-based search and retrieval across your own past notes
  • AI-generated answers to your spoken questions, based on the content of your own notes

The service uses third-party AI models (such as those from OpenAI) to transcribe, structure, and search your content.

Account Registration

To use Retriever, you must:

  • Create an account with a valid email address and password, or sign in using your Apple ID
  • Provide accurate information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account

You are responsible for all activity that occurs under your account.

Subscription and Payment

Subscription Plans

Retriever is offered as a paid subscription, Retriever Pro, with two plans:

  • Retriever Pro Monthly: $9.99 per month, with a 7-day free trial for new subscribers
  • Retriever Pro Annual: $79.99 per year, with a 7-day free trial for new subscribers

Prices are in USD and may vary by country or region; the App Store shows the price in your local currency.

Billing

  • Payment is processed by Apple through the App Store. We do not process or store your payment information
  • Your subscription automatically renews at the end of each billing period unless cancelled at least 24 hours before the renewal date
  • You can manage or cancel your subscription at any time through your Apple ID account settings
  • If you cancel at least 24 hours before your 7-day free trial ends, you will not be charged

Refunds

All refund requests are handled by Apple in accordance with Apple's own refund policies. We do not have the ability to issue refunds directly. Please contact Apple Support or request a refund through your Apple ID purchase history.

Changes to Pricing

We reserve the right to change subscription pricing. Any price changes will not affect your then-current subscription term and will apply to subsequent renewal periods, with notice provided as required by Apple's App Store guidelines.

Acceptable Use

You agree to use Retriever only for lawful purposes. You may not:

  • Use the App to record or process content that violates the rights of others, including recording other individuals without their consent where required by applicable law
  • Attempt to reverse-engineer, decompile, or extract the App's source code or any embedded credentials
  • Use the App in any way that could disable, overburden, or impair our servers or interfere with any other user's use of the App
  • Use automated systems, bots, or modified clients to access the App or its backend services in ways not intended by normal use
  • Use the App for any illegal or unauthorized purpose

We reserve the right to suspend or terminate accounts that violate these Terms.

AI-Generated Content

Accuracy Disclaimer

IMPORTANT: Retriever uses artificial intelligence to transcribe, clean up, and answer questions about your notes. AI-generated content:

  • May contain inaccuracies, omissions, or misinterpretations of what you actually said or recorded
  • Should not be relied upon as a perfectly faithful record of your original spoken words
  • Is generated automatically and is not reviewed by a human before being shown to you

Your Responsibility

You are responsible for:

  • Reviewing AI-generated notes and answers for accuracy before relying on them
  • Using the App's editing feature to correct any notes that were transcribed or structured incorrectly
  • Not relying on Retriever as your sole record of important information without independent verification

Intellectual Property Rights

Our Content

All content in the App, including but not limited to software code, architecture, user interface design, logos, branding, and graphics, is owned by Alchemy Technologies or licensed to us and is protected by intellectual property laws.

Your Content

You retain full ownership of the voice recordings, notes, and content you create using Retriever. By using the service, you grant us a limited license to:

  • Process your recordings through third-party AI services for transcription, structuring, and retrieval purposes
  • Store your notes and associated data to provide the service to you

This license terminates when you delete the relevant note or your account, subject to the data retention terms described in our Privacy Policy.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

No Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Limitation of Damages

WE SHALL NOT BE LIABLE FOR ANY:

  • Loss or inaccuracy of transcribed or AI-generated content
  • Direct, indirect, incidental, consequential, or punitive damages
  • Loss of data, profits, or business opportunities
  • Damages arising from errors, interruptions, or unavailability of the service
  • Damages resulting from third-party AI service inaccuracies or errors

Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless Alchemy Technologies (and its owners), and our service providers, from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use or misuse of the App, your violation of these Terms, or your violation of any third-party rights.

Data Processing and Privacy

Your use of the App is also governed by our Privacy Policy, available at atalchemy.com/retriever/privacy. Key points:

  • Your voice recordings are processed by OpenAI and are not stored as audio after transcription
  • Your notes and account information are stored in our database, accessible only to you
  • We do not sell or share your personal information with third parties for marketing purposes

Service Modifications and Termination

Our Rights

We reserve the right to modify, suspend, or discontinue the App at any time, change features or pricing, update these Terms, and terminate or suspend accounts that violate these Terms.

Your Rights

You may stop using the App at any time and delete your account and all associated data from within the App.

Effect of Termination

Upon account deletion, your right to use the App immediately ceases, and your account data will be permanently deleted within 30 days as described in our Privacy Policy. Provisions regarding liability, indemnification, and dispute resolution survive termination.

Dispute Resolution and Governing Law

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Jurisdiction

You agree that any legal action or proceeding relating to your use of the App shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

Class Action Waiver

To the extent permitted by law, you agree to resolve disputes on an individual basis only. You waive any right to participate in class action lawsuits or class-wide arbitration.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Alchemy Technologies regarding the use of Retriever and supersede all prior agreements or understandings.

Third-Party Services

The App integrates with third-party services (OpenAI, Supabase, RevenueCat, Apple, Sentry, PostHog). Your use of these services is subject to their respective terms and policies. We are not responsible for third-party service performance or availability.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted with an updated "Last Updated" date. Material changes will be communicated via email or in-app notification. Your continued use after changes constitutes acceptance of the modified Terms.

BY USING RETRIEVER, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.
