Agreement to Terms

By accessing or using the Gym Snap mobile application (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Alchemy Technologies (Muhammad Usman Khan, sole proprietorship) ("we," "us," or "our"), the operator of Gym Snap.

Age Requirement

You must be at least 18 years of age to use Gym Snap. By using the App, you represent and warrant that you are 18 years of age or older. We do not knowingly provide services to individuals under 18.

Description of Service

Gym Snap provides:

AI-powered analysis of body photographs
Personalized gym workout plan generation
Workout plan storage and history
Fitness guidance and recommendations

The service uses artificial intelligence (Google Gemini API) to analyze photographs you provide and generate customized workout recommendations based on your fitness goals and experience level.

Account Registration

To use Gym Snap, you must:

Create an account with a valid email address and password
Provide accurate and complete information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

Acceptable Use and Photo Guidelines

Photo Requirements

When using the workout generation feature, you agree to:

Submit only photographs of yourself
Wear appropriate gym attire or minimal clothing for accurate body analysis
Ensure photos are taken in good lighting with clear visibility
Submit unedited, authentic photographs
Take front and back view photographs as instructed

Prohibited Content

You may NOT submit photographs that:

Contain nudity or sexually explicit content
Depict minors (individuals under 18)
Include other people without their consent
Are offensive, abusive, or violate any laws
Have been significantly edited or manipulated to misrepresent your physique
Violate any third-party rights

We reserve the right to terminate accounts that violate these guidelines.

Are NOT a substitute for professional medical advice, diagnosis, or treatment
Should NOT be used for medical decision-making

Are for informational and educational purposes only

Consult Healthcare Professionals

You should:

Consult with a qualified healthcare provider before starting any exercise program
Seek medical advice if you have any pre-existing health conditions, injuries, or concerns
Stop exercising immediately if you experience pain, dizziness, or discomfort
Never disregard professional medical advice based on information from the App

Assumption of Risk

By using Gym Snap, you acknowledge and agree that:

Physical exercise involves inherent risks of injury
You voluntarily assume all risks associated with following workout recommendations
You are solely responsible for your exercise activities and any resulting injuries
You will exercise at your own pace and modify exercises as needed for your abilities
The AI-generated workout plans are suggestions, not prescriptions

Limitations

Gym Snap cannot and does not:

Assess your individual medical condition or physical limitations
Monitor your form or technique during exercises
Prevent injuries or guarantee specific results
Replace professional fitness training or coaching

AI-Generated Content

Content Accuracy

Workout plans are generated by artificial intelligence based on visual analysis of photographs
AI analysis may not be 100% accurate and should be used with discretion
Exercise recommendations are general suggestions, not personalized medical prescriptions
We do not guarantee specific fitness results or outcomes

Your Responsibility

You are responsible for:

Verifying that recommended exercises are appropriate for your fitness level
Using proper form and technique when performing exercises
Adjusting intensity and volume based on your individual capabilities
Seeking professional guidance when needed

Intellectual Property Rights

Our Content

All content in the App, including but not limited to:

Software code and architecture
User interface design
Logos, branding, and graphics
Text, images, and other materials

is owned by Alchemy Technologies or licensed to us and is protected by intellectual property laws.

Your Content

You retain ownership of photographs you submit. By using the service, you grant us a limited license to:

Process your photographs through the AI analysis service
Generate workout plans based on your photos
Store your workout plans in our database

This license terminates when you delete your account.

AI-Generated Workout Plans

Workout plans generated by the App are provided to you for your personal, non-commercial use. You may not redistribute, sell, or commercialize these plans without permission.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

No Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Limitation of Damages

WE SHALL NOT BE LIABLE FOR ANY:

Injuries, deaths, or health complications resulting from use of workout recommendations
Direct, indirect, incidental, consequential, or punitive damages
Loss of data, profits, or business opportunities
Damages arising from errors, interruptions, or unavailability of the service
Damages resulting from AI analysis inaccuracies or errors

Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM (WHICH MAY BE ZERO IF THE SERVICE IS FREE).

Indemnification

You agree to indemnify, defend, and hold harmless Alchemy Technologies (Muhammad Usman Khan, sole proprietorship), and our service providers from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use or misuse of the App
Your violation of these Terms
Your violation of any third-party rights
Injuries or damages resulting from following workout recommendations
Your submission of prohibited or inappropriate content

Data Processing and Privacy

Your use of the App is also governed by our Privacy Policy, available at atalchemy.com/gymsnap/privacy. Key points:

Photos are processed by Google Gemini API (paid tier) and are not stored permanently
Account information and workout plans are stored in our database
We do not sell or share your personal information with third parties for marketing

Service Modifications and Termination

Our Rights

We reserve the right to:

Modify, suspend, or discontinue the App at any time without notice
Change features, functionality, or pricing
Update these Terms at any time
Terminate or suspend accounts that violate these Terms

Your Rights

You may:

Stop using the App at any time
Delete your account and all associated data

Effect of Termination

Upon termination:

Your right to use the App immediately ceases
Your account data will be deleted (except as required by law)
Provisions regarding liability, indemnification, and disputes survive termination

Dispute Resolution and Governing Law

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Jurisdiction

You agree that any legal action or proceeding relating to your use of the App shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

Class Action Waiver

To the extent permitted by law, you agree to resolve disputes on an individual basis only. You waive any right to participate in class action lawsuits or class-wide arbitration.

Severability

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Alchemy Technologies (Muhammad Usman Khan, sole proprietorship) regarding the use of Gym Snap and supersede all prior agreements or understandings.

No Professional Relationship

Nothing in these Terms creates a coach-client, trainer-client, or healthcare provider-patient relationship between you and us.

Third-Party Services

The App integrates with third-party services (Google Gemini API, Supabase). Your use of these services is subject to their respective terms and policies. We are not responsible for third-party service performance or availability.

Export Compliance

You agree to comply with all applicable export and import laws and regulations when using the App.
